Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Financial Stakes and a Will to Win

The owner disclosed operational insights of his 23XI team, revealing he put in $40m of his own funds into the Nascar Cup series team co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”

The Core Dispute: Franchise System and Contract Pressure

At issue is the expiration of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other major leagues with independent franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar demanded teams renew their charters.

Jordan was on the witness stand for about sixty minutes and exited the courthouse to a media frenzy, with fans and media vying for a view or a photo of the global icon.

Spearheading the Fight

Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan said is breaking the law to keep two hands on the wheel.

At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from September 2024. She recounted a frantic and emotional six hours where the racing circuit told teams they must sign a charter agreement extension. This agreement spanned over a hundred pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that 112-page package and take the issue to court. The other 13 organizations agreed to the terms.

The team owners approached Nascar about potential amendments or extension options. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Winning

Ultimately, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he testified, noting that he bought a third charter late in 2024 for $28m amid the legal dispute. “So I took the plunge.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She testified the timing of the contract signing demand was problematic.

According to her, the team founder first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
