US Court Mandates Release of Abrego Garcia from Immigration Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face human smuggling allegations, he was held in immigration custody.
In her order, the judge pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
